Workshop : Foreign Economic Activity - a 360-degree overview

In 2022, Dictum established a representative office in Turkey, Istanbul and actively supports Ukraine-Turkey agreements, so the issue of foreign trade in 2022-2024 was almost one of the profile ones for Dictum.

During the seminar, Svitlana Moroz will share her own experiences, cases, and analyze examples taking into account court practice.

Purpose: This seminar is a fundamental introduction to the legal features of foreign economic activity, features of import and export operations, customs clearance.

  1. Legal features of the EZ and Incoterms rules - 2 hours
    1. Peculiarities of currency contracts - what to consider.
    2. Peculiarities of application of Incoterms rules.
    3. Application of force majeure circumstances taking into account martial law.
    4. State control over import and export operations.
 
 
  1. Financial monitoring of foreign exchange transactions - 1 hour
    1. Entering foreign markets - checking partners in other countries.
    2. Disclosure of the ultimate beneficial owners of foreign partners for the bank.
    3. Verification of transaction documentation by the bank.
    4. Prohibition on carrying out economic activities with countries with which diplomatic relations have been terminated.
 
 
  1. Application of transfer pricing provisions to foreign exchange transactions - 1 hour
    1. If the operation is up to UAH 10 million, is the arm's length principle applied?
    2. Does the arm's length principle apply to export operations, and if so, in which cases.
    3. When and in what cases transfer pricing documentation should be prepared.
    4. Consequences of not providing transfer pricing documentation.

    1. Violation of currency legislation: fines; tax audits; how to avoid
    2. Peculiarities of the functioning of VAT for foreign trade.
    3. Peculiarities of excise tax in foreign trade transactions.
    4. Basis for calculation of import duty.
 
 
  1. Customs clearance of operations – 2 hours
    1. Peculiarities of customs clearance during wartime.
    2. Documentation: invoice, contract, CMR, customs declaration, etc.
    3. Import operations - how to avoid adjusting the customs value of goods.
